As of March 30th there were ten active heron and egret nests in the Shollenberger colony, with more birds arriving every day. The colony is protected from disturbance under the federal Migratory Bird Treaty Act. Even if Dutra's asphalt plant is approved by the Board of Supervisors in May, they will not be able to do any contruction in the area around the colony.
