howardtheduck,
I have no idea whether Mr. Sampson has a meritorious claim, but as far as anonymity is concerned, it certainly is not guaranteed. All that stands between anonymity and "being outed" is a court order. NPR article on the subject: Gotcha! Why Online Anonymity May Be Fading |

"theotherside" - post states war hero Floyd E. Sampson but Floyd G. Sampson replied -
"True, a la Rodney King etc... right? Georgeez , also what is the main complaint against the police?" "If you grew up here, yes (they are notorious). Have you ever seen their metal walled in compound?" Floyd, how are these posts by me considered slander? Did you just include everyone on the first page in your complaint for the hell of it? Waiting for your response Floyd. |
My available time here is short, so my statements will be brief. I need say no more than "I demand a retraction for the comments made or a civil action will be filed." For me to mention "slander" will put these individuals on notice that I intend to include comments they make verbally in the community. The action to be filed will include both slander and libel. |
I'm a Sampson twin. The news article was about me, not my uncle FLOYD E SAMPSON. The slander in the community and libel here is directed against me, FLOYD G SAMPSON. Yes, I replied with a Demand for Retraction. I don't really believe I need to demand a retraction from these individuals before filing an action against them. I chose to be kind and give them an opportunity to redeem themselves. |
Your reply, "yes" was not to, "Are they notorious?" Your reply was to, "Are they 'THAT' notorious? You can retract or come into court with proof. |
Floyd, there I changed it to "that notorious", now how again is this slandering you? Especially since I say "they" and not your name, I was referring to the last name and not you individually. I didn't even read the article, just answered someones question in the comment section. So if you want me to retract, no problem I retract, what I said was never in reference to you, I don't get off on talking bad about someone who is very ill and I'm sorry you saw it that way. |
Thank you for the retract. |

A civil action is being prepared against FedUP, Boopitydoobiedo, WakeupPetaluma, don, petdalumas, SpeesdTrap3 and Big Red. The action for libel and slander will be filed soon. The filing and case number will be published here as well as the true identities of those involved as they are discovered. FLOYD G SAMPSON

There is another set of twins in Sonoma County with the name "Samson". Their name is without the "p". Twin FRANK ANTHONY SAMSON has been convicted of, including, but not limited to: felony theft Penal Code 487(a), felony receiving stolen property Penal Code 496(a) and felony possessing controlled substance Health and Safety Code 11351 in Sonoma County Superior Court SCR 20904; The other twin JOSEPH JOHN SAMSON has been convicted of, including, but not limited to: felony dangerous drugs in Sonoma Superior Court SCR 32398; convicted of felony weapons Penal Code 12020(a) in Sonomaq Superior Court SCR 23026; and convicted of false imprisonment Penal Code 236 in MCR 180570. FINAL DEMAND FOR RETRACTION TO: Boopitydoobiedo; WakeupPetaluma; don, petalumas; SpeedTrap3 and Big Red The comments you made are grossly libelous as it applies to me. I therefore demand that these statements be corrected. The right to publish anonymously is a freedom of speech generally protected by the First Amendment McIntyre v. Ohio Elections Comm'n (1995) 514 U.S. 334, 341-342, 115 S.Ct. 1511, 131 L.Ed.2nd 426, although constritutional protection is not afforded to anonymous speech that is defamatory Chaplinsky v. New Hampshire (1942) 315 U.S. 568, 571-572, 62 S.Ct. 766, 86 L.Ed. 1031. Anonymous speech published on the Internet is afforded the same constitutional protection, but persons targeted by such speech may seek identification of the speaker from the website host or Internet Service provider when the speech is allegedly defamatory. See Krinsky v. Doe6 (2008) 159 Cal. App. 4th 1154, 1167-1170, 72 Cal. Rptr. 3d 231 If the plaintiff succeeds in proving evidence that a libelous staement has been made, the court concluded that no further balancing of interests is necessary to overcome the constitution right to speak anonymously Krinsky v. Doe6 (2008) 159 Cal. App. 4th 1154, 1172, 72 Cal. Rptr. 3d 231 The comments made are so reprehensible and false they effect my reputation in the community and cast aspersions on me. The statements are not privileged, are not true and was not an opinion, but an assertion of fact. I will bring a defamatory action seeking both actual and punitive damages to punish those who made the remarks and to make them an example to deter others. Further research is being done to see if any hate crime violations have occurred. YOU ARE GIVEN TWENTY DAYS FROM TODAY OCTOBER 31, 2009 TO RETRACT! Floyd G Sampson |

Message Retracted. I deleted my post. Next time I see W or J Sampson, the girls I went to school with, I will apologize to them in regards to my article comments as they are both good people and friends of mine. In no way is this a personal attack on you in an attempt to slander "Floyd Sampson",(you have done well at that by your responses to a majority of the publics opinion). I will tell you that I had numerous conversations with the girls and they described a extremly turbulante childhood. I used to feel so sorry for the girls and the STORIES they would tell me about the Sampson "gated community" and the criminal activity that happened out there. I couldnt imagine being raised in that environment. That said, its refreshing knowing that they both are productive members of society. If anyone should write a book it should be W or J Sampson. Let me know when the brothers release their book so I can be there for the signing, after all, the Sampson name is famous in Petaluma and no matter how you attempt to sway peolple out of their opinion, the Sampson name will always be known.
Big Red p.s. you posted the Samson criminal history, why did you not post the Sampson criminal history? Its all public info. Humm......ODD? |

While I would not say anything one way or the other about any members of the Sampson family, I would point out for the benefit of those being threatened with legal action here that in claims of defamation the burden of proof rests with the plaintiff.
That means that the entire life history of the plaintiff becomes open to examination as the plaintiff has to have the conduct of their lives examined against the statements made. Given that the Sampson family is socially prominent in the Petaluma area, and that members of the family have run for political office in the past, it's possible that an argument could be made in rebutall that some members of the family are somewhat in the manner of local celebrities. If that were found to be the case the bar for burden of proof gets raised even higher. But so long as someone wants to post what is in my opinion a bunch of bluster about suing, that is their right. And it is everyone else's right to interpret it as they see fit. Link |
