I have no idea whether Mr. Sampson has a meritorious claim, but as far as anonymity is concerned, it certainly is not guaranteed. All that stands between anonymity and "being outed" is a court order.

Here's some free legal advice... "Slander" is spoken word calumny. Since this is a text based forum, you would need to sue to "Libel". Good luck with your "Discovery", there is so much pending litigation surrounding internet anonymity.

My available time here is short, so my statements will be brief. I need say no more than "I demand a retraction for the comments made or a civil action will be filed." For me to mention "slander" will put these individuals on notice that I intend to include comments they make verbally in the community. The action to be filed will include both slander and libel.

The comments made are so reprehensible and false they effect my reputation in the community and cast aspersions on me.
The statements are not privileged, are not true and was not an opinion, but an assertion of fact.
I will bring a defamatory action seeking both actual and punitive damages to punish those who made the remarks and to make them an example to deter others.
Further research is being done to see if any hate crime violations have occurred.

Message Retracted. I deleted my post. Next time I see W or J Sampson, the girls I went to school with, I will apologize to them in regards to my article comments as they are both good people and friends of mine. In no way is this a personal attack on you in an attempt to slander "Floyd Sampson",(you have done well at that by your responses to a majority of the publics opinion). I will tell you that I had numerous conversations with the girls and they described a extremly turbulante childhood. I used to feel so sorry for the girls and the STORIES they would tell me about the Sampson "gated community" and the criminal activity that happened out there. I couldnt imagine being raised in that environment. That said, its refreshing knowing that they both are productive members of society. If anyone should write a book it should be W or J Sampson. Let me know when the brothers release their book so I can be there for the signing, after all, the Sampson name is famous in Petaluma and no matter how you attempt to sway peolple out of their opinion, the Sampson name will always be known.

While I would not say anything one way or the other about any members of the Sampson family, I would point out for the benefit of those being threatened with legal action here that in claims of defamation the burden of proof rests with the plaintiff.

That means that the entire life history of the plaintiff becomes open to examination as the plaintiff has to have the conduct of their lives examined against the statements made.

Given that the Sampson family is socially prominent in the Petaluma area, and that members of the family have run for political office in the past, it's possible that an argument could be made in rebutall that some members of the family are somewhat in the manner of local celebrities. If that were found to be the case the bar for burden of proof gets raised even higher.

But so long as someone wants to post what is in my opinion a bunch of bluster about suing, that is their right. And it is everyone else's right to interpret it as they see fit.
